How long does a landlord have to return my security deposit?

Short answer

It depends on your state, but most set a deadline somewhere between about two weeks and two months after you move out, with many around 30 days. Within that time the landlord usually has to return the deposit in full, or send an itemized list of deductions along with whatever is left.

The clock usually starts when you return the keys and move out, not when the lease ends on paper. Hand the keys back in a way you can prove, such as in person followed by a text or email confirming the date and time.

  1. Give your forwarding address in writing before or when you move out. In some states the deadline, or your right to penalties, depends on it.
  2. Ask how the deposit will be returned and whether deductions will come with receipts or estimates.
  3. Look up your state's deadline and put it in your calendar the day you move out.
  4. If nothing arrives, follow up in writing a few days after the deadline.

Deductions should be limited to unpaid rent, damage beyond normal wear and tear, and other costs your lease and state law allow. Compare every line against your move-in and move-out photos.
